Health law concerns the rights of institutions providing healthcare services and of individuals receiving those services.

Malpractice means the incorrect application of medical treatment. It concerns unwanted outcomes arising during diagnosis, treatment, care or the period after care that directly affect a patient's health or life.

Malpractice gives rise to a patient's right to seek pecuniary and non-pecuniary compensation. Where a physician's conduct also constitutes an offence, criminal liability may arise.

When assessing pecuniary compensation, lost earnings caused by inability to work and treatment costs resulting from the incorrect treatment are taken into account. The patient and, where the conditions are met, the patient's relatives may also seek non-pecuniary compensation for their pain and suffering.
